DRAFT - NOT LEGAL ADVICE - pending review by Eon Simon and a licensed attorney
DRAFT NOTICE: This is a draft Acceptable Use Policy for waypointmiles.com (intended URL: waypointmiles.com/acceptable-use.html). It is not legal advice and has not been reviewed by an attorney. It must be reviewed and approved by Eon Simon and by a licensed attorney before publication. Items marked "REVIEW FLAG" must be resolved and removed before publication, together with this notice and the DRAFT banner.
Waypoint — Miles made simple
Last Updated: [DATE]
1. Purpose
This Acceptable Use Policy ("AUP") describes what you may not do when using the Waypoint mileage logging and reimbursement service and website at waypointmiles.com (the "Service"), provided by SIMTEK LLC, a Louisiana limited liability company doing business as Waypoint ("Waypoint," "we," "us"). This AUP is part of our Terms of Service. If your organization has a signed agreement with Waypoint, that agreement may add to these rules.
2. Honest Records
You agree not to:
- submit false, inflated, duplicated, or fraudulent trips, mileage, or reimbursement claims;
- alter, backdate, or falsify approvals, signatures, or reimbursement status; or
- sign or approve on behalf of someone else without authorization.
Waypoint calculates distances from the locations you enter. You are responsible for entering trips accurately and reviewing them before you submit or approve them.
3. Student Information and Other Sensitive Data
Do not enter information about students. This includes student names, initials combined with other identifying details, student ID numbers, a student's home address identified as such, or details about a student's education, services, discipline, or health — in trip purposes, notes, stop names, or any other field — unless your organization has expressly authorized this under a signed data privacy agreement with Waypoint.
Instead, use a generic description, for example: "Home visit," "Student services — Elementary campus," or "IEP meeting — [School name]."
Also do not enter information that is not needed for mileage reimbursement, such as:
- Social Security numbers, driver's license numbers, or bank or card account numbers;
- health or medical information about you or anyone else; or
- personal information about other people beyond what is needed to identify a business destination.
REVIEW FLAG — Student data guardrails: This prohibition supports the FERPA "no student data" posture described in the Terms and Privacy Policy. It needs product support (field hints, warnings when a trip note looks like a name, and an "address withheld" home-visit option) because users will not always comply. Confirm the example wording with an organization partner, and confirm Louisiana requirements (La. R.S. 17:3913–3914) with counsel.
4. Accounts and Access
You agree not to:
- share your password or other sign-in credentials, or let others use your account (a Solo plan is for one person; teams must use a Team plan);
- access another person's account or data without authorization, or go beyond the role your organization assigned you;
- create accounts using false information, or create repeated accounts to obtain additional free trials; or
- use the Service if you are under 18 or a student.
5. Security and Technical Misuse
You agree not to:
- probe, scan, or test the vulnerability of the Service, or bypass authentication or security measures (unless authorized in writing — see Section 8);
- interfere with or disrupt the Service, including by overloading it, sending malware, or using automated scripts, bots, or scrapers;
- reverse engineer, decompile, or copy the Service, except as permitted by law; or
- resell, sublicense, or provide the Service to third parties except as allowed in a signed agreement with Waypoint.
6. Map and Third-Party Content
Waypoint uses Google Maps Platform to calculate distances. You agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. You agree not to scrape, bulk-download, cache, or extract map data, geocoding results, or route data from the Service, remove or obscure Google attribution, or use it to build a competing mapping or location product. Do not misuse other Third-Party Services connected to Waypoint (such as Google Sign-In, your organization's SSO, or Stripe).
7. Legal Compliance
You agree not to use the Service in violation of any law, regulation, or the rights of others, including privacy, employment, tax, and public-records laws, or to store or send content that is unlawful, harassing, or infringing.
8. Reporting Problems and Security Issues
If you see a violation of this AUP or believe you have found a security vulnerability, email appsupport@waypointmiles.com. If you report a vulnerability in good faith, do not access more data than needed to show the issue, and give us reasonable time to fix it before disclosing it, we will not pursue legal action against you for that research. [CONFIRM SAFE-HARBOR POSITION WITH COUNSEL.]
If you accidentally entered student information or other sensitive data, delete or edit the entry and tell your administrator; if you cannot remove it, email appsupport@waypointmiles.com.
9. Enforcement
We may investigate suspected violations. If you violate this AUP, we may remove content, suspend or terminate access, or notify your organization's administrator, and we may report unlawful activity to authorities. Where practical, we will notify you first and give you a chance to fix the problem. For organization accounts, we will generally work with the Customer's administrator.
REVIEW FLAG — Enforcement for organization accounts: Organizations may require notice before Waypoint suspends their users or removes records (records may be public records). Align with Organization Agreements.
10. Changes
We may update this AUP and will change the "Last Updated" date. Material changes will be announced as described in our Terms of Service.
REVIEW FLAG — Notice address: At Eon's direction, the SIMTEK LLC mailing address has been removed from the website; contact is SIMTEK LLC at appsupport@waypointmiles.com. A physical or mailing address for notices may be legally required (for example under privacy, consumer-protection, or e-commerce rules). Waypoint Legal to confirm.
